Well, in a perfect world, you speak to the insurance company for the person that hits you. You give them your medical bills. They inspect your car, determine whether it’s a total loss or can be repaired. They take care of it, and you’re done in no time.
Of course, it’s not a perfect world, and sometimes things don’t work out the way you want them to.

They may dispute the value of your vehicle if it’s a total loss or the cost to repair it. The insurance company may even dispute that you’re at fault based on something that they’re insured told them so that could cause further delay.

On top of just disputing the damages in the case, the insurance company could delay or just make a totally unreasonably lowball settlement offer.
It could force you to file a claim, file a lawsuit, or even need to hire a lawyer.
So even though you’re not at fault for the car accident, it might not be smooth getting your case resolved.
